Judiciary

  1. To justify a wrong is to perpetuate it, which the docile Supreme Court of Pakistan has done by sanctifying the Doctrine of Necessity to facilitate the take over of civilian governments under four martial laws.
  2. Resorting to the Doctrine of Necessity every time to affirm repeated impositions of martial laws, the Supreme Court has committed the cardinal error of abandoning its oath to protect the Constitution and, while exercising powers not vested in it, has presumed to act for the good of the people sick of martial laws.
  3. Justice is buried when judges give ostensibly right reasons for wrong decisions.
  4. The tragedy of Pakistan is constant martial laws and inconstant judiciary.
  5. Judiciary is required to defend the law of the country and the order of the society. If military takes away the law, it protects order no matter whose, provided the law-giver carries bayonet.
  6. Hard cases cannot be decided by the settled laws of the land, as such laws and precedence do not apply to the unique or oppressive situations. They are resolved by the civilized norms of the affected society, as embedded in the conscience, if any, of a judge.
  7. One of the main reasons for. the success of democracy in Britain, India and Amuica is the jealous and relentless adherence of their judges of the superior courts to the concept and practice of the independence ofjudiciary except deference to the legislature in some aspects of law, which traits alone inspire respect and confidence in the rule oflaw, a fundamental cannon of democracy.
  8. If the judiciary of a country is not truly independent, it is just an institution and not a just institution.
  9. Justice has meaning, if there is a reasonable belief that justice will be done; otherwise, it is a fa\’.ade devoid of conviction.
